These Terms of Service (“Terms”) govern your access to, and use of services provided by AlignSmart Technologies, Inc. (“AlignSmart,” “we,” “us,” or “Company”). By accessing or using any of our services—including mobile apps, website features, practitioner tools, training programs, or hardware (“Services”)—you agree to be bound by these Terms and our Privacy Policy (last revised August 1, 2025).

1. Eligibility & User Accounts

  • You must be at least 18 years old to use the Services. By using the Services, you affirm that you are 18 or older.
  • Practitioners and organizations using AlignSmart must register and may be required to complete identity and consent verification before accessing practitioner tools and materials.

2. Services Overview

  • AlignSmart provides a patent-pending, science-based system for posture assessment and correction, including a 20-point posture assessment, the proprietary AlignScore™, personalized corrective routines, and mobile app support.
  • We offer certification programs, practitioner software, and training to empower professionals to conduct assessments and deliver corrective guidance.
  • Organizations may access AlignSmart through flexible deployment models—on-site, remote, or hybrid—via the AlignSmart Alliance.

3. User Obligations

  • You agree to provide accurate, current, and complete information when registering and to update it as needed.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Intellectual Property

  • All content, including the AlignScore™, assessments, routines, training materials, and associated software, are the intellectual property of AlignSmart or its licensors. Unauthorized use, reproduction, or distribution is prohibited.

5. Data Collection & Privacy

  • AlignSmart collects personal and non-personal data, such as clinic/facility identifiers, email, phone, before-and-after photos, anonymized alignment measurements, usage logs, error reports, and app engagement metrics.
  • Data may be used to operate the system, improve services, support communications, research, and analytics. You may opt out of promotional emails by contacting us at info@alignsmart.com, or by clicking on the “unsubscribe” link provided in such emails.
  • Sensitive data such as photos is stored securely using encrypted cloud storage hosted on AWS. Non-personal usage data is stored separately for analysis.
  • You may request access to or deletion of your personal information by submitting a request (including notarized affidavit) to info@alignsmart.com. Upon verification, we will act within 72 hours.
  • AlignSmart does not target or knowingly collect data from individuals under 18. If any such data is received, we will delete it promptly.

6. Location-Based & Cookie Technologies

  • Our apps may collect anonymized location data and use cookies to personalize user experiences, measure engagement, and support advertising.
  • You may opt out of location services via your device settings. Disabling cookies may affect functionality.

7. Third-party Services & Disclosures

  • We may share information with strategic partners or third-party service providers to deliver services, but never for their independent marketing.
  • AlignSmart may disclose personal data when required by law or to protect our rights or users, as well as during reorganizations or sale of the company.

8. Disclaimers & Limitation of Liability

  • AlignSmart’s Services are educational and corrective in nature and are not a substitute for professional medical advice. Users should consult qualified professionals for health concerns.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIGNSMART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

9. Termination

  • We reserve the right to suspend or terminate access to any Services at our sole discretion, including in cases of violation of these Terms.

10. Modifications

  • We may update these Terms from time to time. Continued use after notice of updates constitutes acceptance. The most current Terms will be available via our website.
